General Terms and Conditions

1. Scope and Applicability
These General Terms and Conditions (“Terms”) apply to all purchases made via Evelli AB’s website or otherwise entered into with Evelli AB, company registration number 559225-2836, Sturegatan 44 A, 114 36 Stockholm, Sweden (“Evelli”).The Terms apply to both consumers (B2C) and business customers (B2B). For business customers, specific provisions apply as set out in Section 15.By completing a purchase, the customer accepts these Terms.Agreements may be concluded in Swedish or English. In case of interpretation disputes, Swedish law shall apply.
2. Governing Law and Jurisdiction
These Terms are governed by Swedish law.Disputes shall be settled by Swedish general courts, with the Stockholm District Court as the court of first instance, unless otherwise required by mandatory consumer protection legislation.Consumers have the right to submit disputes to the Swedish National Board for Consumer Disputes (ARN) and may also use the EU Commission’s Online Dispute Resolution (ODR) platform.
3. Conclusion of Contract
A binding agreement is formed only once Evelli has confirmed the order by email.Evelli reserves the right to refuse or cancel an order in cases of:Incorrect pricing

Technical errors

Suspected fraud

Insufficient stock availability

Incorrect customer information

4. Prices and Taxes
Prices are stated inclusive of VAT for consumers. For international customers, local taxes, customs duties and import fees may apply.For deliveries outside the EU, the customer is responsible for all customs duties, import charges and local taxes.Evelli does not deliver on DDP (Delivered Duty Paid) terms.Evelli is not responsible for delays or costs arising from customs clearance in the destination country.
5. Payment
Payment is processed via Klarna in accordance with Klarna’s terms and conditions.Evelli is not responsible for Klarna’s credit assessments or processing of personal data.In case of suspected fraud or non-payment, Evelli reserves the right to withhold delivery.
6. Delivery and Transfer of Risk
Normal delivery time is up to 7 days within Sweden and up to 14 days internationally.Evelli delivers globally but reserves the right to restrict delivery to certain regions.Risk in the product passes to the customer upon receipt of the goods.Evelli is not liable for indirect damages resulting from delivery delays.
7. Right of Withdrawal – Consumers
Consumers within the EU have a 14-day right of withdrawal in accordance with applicable distance selling legislation.Returned products must be sent in the original packaging and in substantially unchanged condition.The customer bears the return shipping cost and the risk during return transport.Evelli reserves the right to deduct an amount corresponding to any decrease in value caused by handling beyond what is necessary to determine the nature, characteristics and function of the product.Refunds are processed within the legally prescribed timeframe after the returned product has been received and approved.
8. Complaints and Warranty
Evelli provides a one (1) year commercial warranty from the date of delivery.In addition, mandatory consumer protection legislation applies, including a three-year right to complain under Swedish consumer sales law.In case of complaint, the customer must contact support and provide the product serial number before returning the product.Evelli has the right to:Repair the product

Replace the product

Refund the purchase price

Evelli determines which remedy is most appropriate.The warranty does not cover:Normal wear and tear

Incorrect installation

Accidental damage

Use contrary to instructions

9. Returns

SwedenThe product must be properly packaged.Evelli is not responsible for damage occurring during return transport.
10. Product Use
The product must be used in accordance with the provided instructions.Evelli is not liable for damage resulting from improper use or modification of the product.
11. Application and Software
The application is provided free of charge and is licensed, not sold.Evelli grants a limited, non-exclusive and non-transferable license to use the application in connection with Evelli products.Evelli reserves the right to:Update or modify features

Restrict functionality

Discontinue services

Evelli is not responsible for:Interruptions caused by third-party networks

Internet disruptions

Operational disturbances beyond Evelli’s control

The application is provided “as is” to the extent permitted by law.
12. Limitation of Liability
Evelli’s liability is limited to direct damages and shall under no circumstances exceed the amount paid by the customer for the relevant product.Evelli shall not be liable for indirect damages such as:Loss of profit

Production loss

Loss of data

Consequential damages

This limitation applies to the extent permitted by applicable law.
13. Force Majeure
Evelli shall not be liable for failure to perform its obligations due to events beyond Evelli’s reasonable control, including but not limited to natural disasters, war, pandemics, governmental actions, strikes, or supply chain disruptions.
14. Intellectual Property Rights
All intellectual property rights relating to the products, application, design, trademarks and technology belong to Evelli AB.No part may be copied, reproduced or used without written permission.
15. Special Provisions for Business Customers (B2B)
For business customers, the following applies in addition to the above:Complaints must be made without undue delay and no later than twelve (12) months from delivery.

The Swedish Sale of Goods Act (1990:931) applies instead of consumer protection legislation.

Evelli shall under no circumstances be liable for indirect damages.

Evelli’s total liability is limited to the invoice amount.

Payment terms for separately agreed business purchases may be net 30 days subject to approved credit assessment.

Title to the goods remains with Evelli until full payment has been received (retention of title).
